Agreement to These Terms
These Terms of Service ("Terms") are a binding agreement between you and Food Allergy Chart ("Food Allergy Chart," "we," "us," or "our") governing your access to and use of our website, restaurant management tools, and public allergy guides (collectively, the "Service").
By creating an account, accepting an invitation, clicking to accept these Terms, or using the Service, you agree to these Terms and our Privacy Policy. If you use the Service for a company or other organization, you represent that you have authority to bind that organization, and "you" includes that organization. If you do not agree, do not use the Service.
Eligibility and Accounts
You must be at least 18 years old and legally able to enter into a contract to create an account. Public guides may be viewed without an account. Account users must provide accurate information, keep credentials confidential, use only accounts and workspaces they are authorized to access, and promptly notify us of suspected misuse.
Business account owners and administrators control invitations, roles, permissions, and customer content in their workspaces. They are responsible for their users' authorized use of the Service and for removing access when it is no longer appropriate. An account is personal to the registered user and may not be shared.
The Service
Food Allergy Chart helps restaurant customers organize menu and allergen information, manage locations and team access, import and review catalog data, publish guest-facing allergy guides, and create sharing and staff-reference materials. We may add, change, limit, suspend, or discontinue features, provided that we will give notice when reasonably practical if a material change significantly reduces an active customer's core Service.
Early Access and Future Paid Plans
The Service is currently offered as free early access and does not require a credit card. We may introduce paid plans or usage limits in the future. We will disclose applicable prices and material plan terms before charging you, and we will not charge a payment method unless you separately authorize the purchase. Any future order form, plan description, or checkout terms will supplement these Terms and will control for that purchase if there is a direct conflict.
Important Allergy and Safety Notice
The Service is an information-management and publishing tool. It does not provide medical advice, diagnose or treat any condition, recommend what a person should eat, or guarantee that any food is safe. Food Allergy Chart does not independently inspect kitchens, ingredients, recipes, labels, suppliers, preparation practices, or restaurant-published information.
Ingredients, recipes, substitutions, availability, suppliers, shared equipment, and preparation practices can change, and cross-contact can occur. A filter result means only that the restaurant's published data marks the item as meeting the selected filter at that time. Guests should confirm current information with the restaurant, use their own judgment, and follow advice from a qualified healthcare professional. In an emergency, contact local emergency services.
Customer Responsibilities
Restaurant customers and their account users are solely responsible for:
- the accuracy, completeness, timeliness, and lawful use of customer content;
- reviewing imports, mappings, automated suggestions, and menu-source data before publishing or relying on them;
- maintaining appropriate food-safety, allergen, cross-contact, staff-training, and emergency procedures;
- obtaining all rights, permissions, and notices needed for content and personal information they submit;
- configuring user permissions and public guide settings appropriately; and
- keeping their own source records and operational backups where reasonably necessary.
The Service is not a substitute for a restaurant's legal, regulatory, labeling, food-safety, or accessibility obligations. Customers must promptly correct or remove content they know is inaccurate, misleading, unlawful, or unsafe.
Customer Content
As between you and Food Allergy Chart, you retain your rights in content you submit to the Service. You grant us a worldwide, non-exclusive, royalty-free license to host, copy, process, adapt for technical formatting, display, and distribute that content only as reasonably necessary to provide, secure, support, and improve the Service and to make content public when you direct us to publish it.
You represent that you have the rights and authority needed to submit and use customer content through the Service and that doing so will not violate law, another person's rights, or an agreement. You should not submit protected health records, payment-card data, government identifiers, or other sensitive personal information that the Service is not designed to receive.
Acceptable Use
You may not, and may not help another person to:
- use the Service unlawfully, deceptively, fraudulently, or in a way that creates a safety risk;
- access or attempt to access an account, workspace, system, or data without authorization;
- interfere with, disrupt, overload, probe, scan, or test the vulnerability of the Service;
- upload malware or content that is unlawful, infringing, misleading, defamatory, or harmful;
- scrape or extract data at scale except through a feature or written permission we provide;
- reverse engineer or circumvent technical restrictions except to the extent law expressly permits it;
- use the Service to build or train a competing product without our written permission; or
- misrepresent affiliation with Food Allergy Chart or remove proprietary notices.
Our Intellectual Property
The Service, including its software, design, branding, documentation, and other platform materials, is owned by Food Allergy Chart or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. No other rights are granted. Third-party names and marks belong to their respective owners.
Feedback
If you voluntarily provide feedback or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation. This does not give us ownership of your customer content or personal information.
Third-Party Services and Links
The Service relies on third-party infrastructure and may link to or retrieve information from restaurant-selected websites, menu providers, map services, authentication providers, or other third parties. We do not control and are not responsible for third-party services, content, availability, or privacy practices. Your use of a third-party service may be governed by that provider's terms and policies.
Privacy
Our Privacy Policy explains how we handle personal information. By using the Service, you acknowledge the practices described there. Each customer is responsible for providing any notices and obtaining any permissions required for personal information it submits or directs us to process.
Suspension and Termination
You may stop using the Service at any time and may request account closure through the contact form at foodallergychart.com/contact. We may suspend or terminate access if we reasonably believe you violated these Terms, used the Service without authorization, created a security or safety risk, failed to comply with law, or if continued operation is not commercially or technically feasible. When practical, we will provide notice and an opportunity to address the issue.
After termination, your right to use the Service ends. Provisions that by their nature should survive will survive, including ownership, disclaimers, liability limitations, indemnity, dispute, and general provisions. Our handling of retained information remains subject to the Privacy Policy and applicable law.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." FOOD ALLERGY CHART DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE OR CUSTOMER-PUBLISHED INFORMATION WILL BE COMPLETE, CURRENT, ERROR-FREE, SECURE, OR UNINTERRUPTED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THIS SECTION MAY NOT APPLY TO YOU.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOOD ALLERGY CHART AND ITS OWNERS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; OR DAMAGES ARISING FROM CUSTOMER-PUBLISHED INFORMATION, FOOD OR ALLERGEN DECISIONS, CROSS-CONTACT, UNAUTHORIZED ACCOUNT USE, OR THIRD-PARTY SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOOD ALLERGY CHART FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100. THESE LIMITS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any liability for fraud, willful misconduct, gross negligence, or death or personal injury where applicable law prohibits that limitation. Mandatory consumer rights remain unaffected.
Business Customer Indemnity
If you use the Service for a business, you will defend, indemnify, and hold harmless Food Allergy Chart and its owners, affiliates, personnel, and service providers from third-party claims, damages, losses, liabilities, and reasonable costs (including attorneys' fees) arising from your customer content, your restaurant's food or allergen information or practices, your users' misuse of the Service, or your violation of these Terms or law. We will provide prompt notice and reasonable cooperation, and you may not settle a claim in a way that admits fault by or imposes obligations on an indemnified party without written consent. This section does not apply to an individual acting solely as a consumer viewing a public guide.
Disputes and Applicable Law
Before filing a formal claim, you and Food Allergy Chart agree to make a good-faith effort to resolve the dispute by written notice through the contact form at foodallergychart.com/contact and 30 days of informal discussion. These Terms are governed by applicable law, without overriding any mandatory protection of the law where a consumer lives. Any claim must be brought in a court with lawful jurisdiction over the parties and dispute. Nothing in this section prevents either party from seeking urgent injunctive relief or using an eligible small-claims process.
Changes to These Terms
We may update these Terms to reflect changes to the Service, our business, or applicable law. We will post the updated Terms and revise the effective date. If a change materially affects existing account users, we will provide additional notice when reasonably practical. Changes apply prospectively from their effective date. Your continued use after that date means you accept the updated Terms; if you do not agree, you must stop using the Service.
General Terms
These Terms, the Privacy Policy, and any applicable order or written customer agreement are the entire agreement about the Service and replace prior discussions on the same subject. A specific signed agreement or order controls over these Terms to the extent of a direct conflict. If a provision is unenforceable, it will be modified only as much as necessary and the rest will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, sale, or transfer of the Service. These Terms do not create an agency, partnership, employment, or third-party-beneficiary relationship. Section titles are for convenience only.
